Practical Support for GDPR Obligations

GDPR sets requirements for how personal data is collected, used, shared and transferred. We establish whether it applies to you, then build the governance and documentation to meet it.

Assess whether processing falls within GDPR’s territorial scope, including activities carried out in the context of an EU establishment and relevant offering of goods or services to, or monitoring of, individuals in the EU.

Activities That Can Bring an Organization Within Scope

GDPR can apply to organizations outside Europe. Whether it does depends on what the organization does and whose data it handles.

  • Operating in the EU or EEA

Having an office, employees or other establishment in the EU or EEA, where personal data is processed in the context of that establishment’s activities.

  • Offering Goods or Services to People in the EU or EEA

Marketing or selling to individuals located in the EU or EEA, including through a website or app directed at them.

  • Monitoring Behavior in the EU or EEA

Tracking, profiling or analyzing the behavior of individuals located there, including through online tracking technologies.

  • Processing on Behalf of a Customer Subject to GDPR

Providing processing services to a GDPR-regulated customer may create contractual data protection obligations. Whether GDPR applies directly to your organization requires a separate territorial scope assessment.

  • Receiving Personal Data from Europe

Receiving personal data from an EU or EEA organization may involve GDPR transfer safeguards and contractual requirements, even where the recipient is not independently subject to GDPR.

  • Using Vendors Outside the EEA

Sending personal data to cloud providers or service providers located outside Europe.

International Data Transfers

Transfers of personal data from the EEA to countries outside the EEA must comply with GDPR’s international transfer rules. Depending on the circumstances, organizations may rely on an adequacy decision, appropriate safeguards such as Standard Contractual Clauses, or a limited derogation.

We map your cross-border data flows, identify the mechanism relied on for each one, support Standard Contractual Clauses and related documentation, and carry out transfer impact assessments where relevant. We also help you keep this under review as vendors, locations and sub-processors change.

FAQs

Frequently Asked Questions

It can. GDPR may apply to organizations outside Europe that offer goods or services to people in the EU or EEA, or monitor their behavior. We assess your activities to see whether it does.

A controller decides why and how personal data is processed. A processor handles it on the controller’s behalf. Your role determines your obligations and the contract terms you need.

GDPR requires a DPO in certain circumstances, including where core activities involve large-scale regular and systematic monitoring or large-scale processing of specified sensitive data. We help assess whether the requirement applies and how the role should be structured. Where Supportix Global provides DPO support, independence and conflict-of-interest requirements must be met, as described on our Fractional Privacy Officer & DPO Services page.

Certain organizations outside the EU that fall within GDPR’s territorial scope must designate an EU representative, subject to applicable exceptions. This role is distinct from a Data Protection Officer. We help assess whether the requirement applies.

Standard Contractual Clauses are European Commission-approved contractual safeguards used for certain international transfers of personal data. Their use may require additional assessment and supplementary measures, depending on the transfer circumstances.

Yes. A DPIA, a records-of-processing exercise or a transfer review can be scoped as a defined project, separate from a broader program engagement.

Supportix Global provides privacy compliance consulting, including applicability assessments and implementation support. Where a formal legal opinion is required, it should be obtained from qualified legal counsel.
